There’s something wrong with a system that allows its Supreme Court to be politically based rather than law based.

@Kathryn Barr... I'm sure you meant "biased" here.

Anyway, there will always be bias in humans. Justices on the Supreme Court are humans. If you want a fair Supreme Court, you're going to have to wait for AI to be perfected... and even then the biases of the creators/programmers will affect its performance.

There is NO SUCH THING as unbiased when dealing with the thinking animal H. sapiens.

The problem, well, one of the many, many problems, is politically appointed judges. Judges should be politically neutral and uncontroversial, not be appointed to further a particular agenda.

High court judges are, of course, people who are going to have political biases and assumptions. But, I think the critical thing apart from being qualified is that they understand the job.

A good supreme court judge reads the room because a supreme/high court lives or dies (sometimes literally) based entirely on the general public's view of its legitimacy.

So if that court's rulings are too far off from the general public's sense of justice and fairness for too long the judges on that court will have made themselves into tyrants without an army.

Which is a precarious position.

The obvious trick for avoiding that situation is to not appoint/elect/select/whatever radicals or extremists to high courts. And that's where Americans failed. Repeatedly.
